DONATION, CANCELLATION & REFUND POLICY

1. INTRODUCTION & ORGANIZATIONAL MANDATE

Abhivadya Foundation is a registered Section 8 non-profit enterprise under the Indian Companies Act, 2013, working extensively across Agriculture, Community Development, Skill Development, Advocacy, Women Empowerment, Education and Training, Environmental Conservation, Gender Equality, Sustainable Development, Child Rights and Protection, Mental Health Support, Poverty Eradication, Digital Literacy, Nutritional Science, Cultural Activities, Socio-Political Awareness, e-Governance, and Disaster Management.

We deeply appreciate the generosity and trust of our donors, partners, and participants. As a non-profit organization dedicated to social welfare, we maintain complete transparency, integrity, and fiscal discipline in all financial transactions. This policy governs the terms, conditions, and procedures regarding refunds, cancellations, and transaction adjustments across all our programs and digital portals.

2. DONATIONS & CONTRIBUTION REFUND TERMS

2.1 General Non-Refundable Rule
All donations made to Abhivadya Foundation are voluntary and are used promptly for charitable programs and community welfare activities. As a general rule, successfully processed and accepted donations are final and non-refundable. A change of mind, dissatisfaction with general project outcomes, or lack of interest after contribution does not constitute valid grounds for a refund.

2.2 Qualifying Exceptions for Donation Refunds
Refund requests for donations will strictly be evaluated only under the following specific technical or verified operational circumstances:
• Duplicate Transactions: Where a donor accidentally executes multiple identical online payments for a single donation attempt.
• Technical or System Errors: Where an incorrect amount is charged due to a verified payment gateway, banking server error, or typing glitch.
• Unauthorized Transactions: Where a payment is proven to have been executed fraudulently from a third-party account without the account holder's authorization, as verified by the bank or payment gateway.
• Uncredited Deductions: Where funds are debited from the donor's bank account but fail to be successfully credited or reconciled in Abhivadya Foundation's accounts.

2.3 Absolute Tax Exemption Restriction (80G Non-Refundability)
In strict accordance with Indian Income Tax regulations, no refund shall be granted under any circumstances if a Tax Exemption Receipt under Section 80G of the Income Tax Act, 1961 has already been generated, issued, or claimed by the donor. Once an 80G certificate is registered in the statutory database, the transaction is legally irrevocable.

3. TRAINING, WORKSHOPS & EVENT CANCELLATION TERMS
Where Abhivadya Foundation conducts paid training programs, educational workshops, skill development activities, certifications, or awareness seminars, the following cancellation parameters apply:
• Participant-Initiated Cancellation: Written cancellation notices received at least seven (7) days prior to the program commencement date may be eligible for a refund, minus applicable administrative and payment gateway processing fees.
• Non-Eligibility Post-Commencement: No refund shall be provided once the program has commenced, or if the registered participant has attended any session, accessed digital course materials, or failed to attend without prior notice.
• Foundation-Initiated Cancellations: If Abhivadya Foundation cancels or indefinitely postpones a training program or workshop due to administrative or unforeseen reasons, participants will be offered a choice of either: (a) A 100% full refund of the fee paid, or (b) Free credit transfer of registration to the next available batch.

4. MEMBERSHIP & APPLICATION PROCESSING FEES
Membership registration fees, application processing charges, and document verification fees are generally non-refundable once administrative processing has commenced. Refunds for membership payments are restricted to duplicate debits, technical payment processing glitches, or instances where the application cannot be reviewed due to an administrative error on the part of the foundation.

5. INTERNATIONAL DONATIONS & FCRA COMPLIANCE (NEW INCLUSION)
All foreign contributions and international donations processed under the Foreign Contribution (Regulation) Act (FCRA), 2010 are subject to RBI guidelines and central government regulations:
• FCRA Routing & Reversals: Approved refunds for foreign donations can only be reversed directly to the originating international bank account through official FCRA banking channels.
• Currency & Banking Deductions: Any foreign exchange rate fluctuations, intermediary bank charges, or international wire transaction fees incurred during processing or reversal will be deducted from the net refunded amount.

6. ACCESS & PORTAL TECHNICAL ISSUES (NEW INCLUSION)
A request for a refund will not be entertained merely because a donor or participant did not immediately receive automated sign-up confirmation emails, user credentials, or tax receipts due to spam filters or email server delays.
In such cases, users should contact our support team at our official email. Abhivadya Foundation commits to resolving all portal access queries, resending login credentials, or issuing receipt duplicates within seven (7) working days of receiving the query.

7. REFUND APPLICATION PROCEDURE & MANDATORY REQUIREMENTS
To submit an eligible refund request, the applicant must send a formal written application via email or post to Abhivadya Foundation within seven (7) calendar days from the date of the transaction (or within 30 days for verified credit card technical error disputes).
The written request must contain all of the following mandatory details:
• Applicant Details: Full Name, Mobile Number, and Mailing/Email Address.
• Transaction Metrics: Exact Date of Payment, Amount Paid, Payment Gateway/Method used, and Payment Reference / Transaction ID.
• Justification & Evidence: Specific reason for requesting a refund accompanied by valid proof of payment (e.g., bank statement excerpt, payment receipt copy, or screenshot of duplicate debit).

8. PROCESSING TIMELINES & METHOD OF REFUND
• Mode of Payment: All approved refunds will be credited back exclusively via the original payment method (e.g., net banking, UPI, credit/debit card). Refunds will strictly NEVER be paid out in cash.
• Processing Window: Upon verification and approval by the finance desk, refunds will be initiated within 7 to 14 working days. The actual credited amount reflection time may vary depending on banking institutions and payment gateway providers (typically taking up to 30 working days for credit card disputes).
• Fee Deductions: In cases of user-side cancellations or error claims, payment gateway processing fees and bank transaction charges will be deducted from the total refund amount. In cases of foundation error or proven duplicate technical glitches, the foundation will absorb standard gateway charges.

9. DISPUTE RESOLUTION & RIGHT TO REJECT
Abhivadya Foundation reserves the absolute right to evaluate and reject refund requests that:
• Time-Barred Submissions: Are submitted after the prescribed submission window.
• Incomplete Records: Lack sufficient supporting evidence, transaction receipts, or required identity verification details under data privacy norms.
• Issued Tax Receipts: Involve donations for which 80G tax exemption certificates have already been generated or claimed.
• Utilized Contributions: Relate to voluntary donations that have already been allocated or deployed into active field operations.
All disputes, grievances, and refund claims will be handled with procedural fairness, speed, and confidentiality under our open-door governance. In all matters concerning the interpretation and execution of this Refund Policy, the decision of the Governing Body / Board of Directors of Abhivadya Foundation shall be final and legally binding.

10. DATA PRIVACY & POLICY UPDATES
All personal information collected during the refund application process will be handled confidentially and in strict compliance with the Digital Personal Data Protection (DPDP) Act, 2023. Abhivadya Foundation reserves the right to amend, update, or modify this policy at any time without prior individual notice. Revisions will be published on the official website and will take effect immediately upon posting.
